If a tree overhangs the boundary and encroaches on the adjoining property the owner of the tree is not responsible for the removal of the overhanging proportion of the tree. The owner of the tree does not become liable until actual damage has been caused. The adjoining property owner would be perfectly within their rights to remove the offending branches without prior permission from the owner of the tree. However, to avoid disputes it is advisable to speak to the tree owner before removing any branches.
English Oak (Quercus Robur)
A long-living tree, capable of living for hundreds of years, the English oak has long been revered. It features in Greek and Norse myths and the Bible and was also worshipped by the druids. In practical terms, the oak has historically been much valued for its strong, durable timber; for centuries, the ships in the English Royal Navy were built out of sturdy oak. The bark, with its high tannin content, was used by the tanning industry, while acorns, the fruit of the oak tree, provided valuable food for pigs. Oak trees, especially mature ones, play an important part in the forest�s ecosystem, providing food and shelter for many creatures from insects to birds as well as animals such as squirrels.
